EI Customers may collect and manage Personal Data when using our platform and services, or what is referred to as the Subscription Service. “Subscription Service” means all of our web-based applications, tools, and platforms. When subscribing to our platform and services, EI processes Personal Data as a processor under the direction of our Customers. Our Customers, data controllers, are responsible for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to collecting their Customers’ Personal Data using the Subscription Service.
This Privacy Policy may be revised, and users are encouraged to review this Privacy Policy periodically. Privacy Policy changes are updated on this page and, where updates are material, email notifications may be issued, or if for those with EI platform and subscription, will be notified within the platform.

1. What Information is Collected and Processed
a. Information Provided to EI
When interacting with our website or any sites or services that link to this Privacy Policy or use the Subscription Service, EI may collect Personal Data and other information. When visiting our website, EI collects Personal Data through web forms and interacting with our websites. For example, by registering to access EI Resources, signing up for a webinar, subscribing to one of our services, including professional services, or requesting customer support, generally business email, first and last name, job title, contact number, and other similar business information is collected.
Inbound and Other Event Information
When registering for EI events, information such as name address, phone number, and email address is collected. This information is used to communicate with and some cases facilitate registration. Additionally, registration data may be shared with service providers of inbound events and to improve your experience for future EI events.
Account and User Information
Personal Data is collected when signing-up for an EI account, creating or modifying user information, setting preferences, or providing any other related information to access or utilize our Subscription Service.
Payment Information
We collect payment and billing information when registering for platform or services subscription, such as billing address or a billing account contact. Payment information is as authorized, such as a credit card number or bank account number, is processed in accordant with this Privacy Policy. Secure third-party payment service providers are used to manage payment processing and collected through a secure payment process.
Customer Testimonials
Customer testimonials and comments are posted on our website, which may contain Personal Data. Customer’s consent via email or through other Agreements between the Customer and EI is obtained prior to posting the Customer’s name and testimonial.
Information Processed on Behalf of Customer’s Using Subscription Service
Customers using our product may collect Personal Data such as first and last name, email address, business address, phone number, or other information. The content of our customers’ webpages or the types of Personal Data that our customers may choose to collect or manage using the Subscription Service is not under our control. Our customers’ information is maintained in our service providers’ infrastructure and is processed as a processor under our customers’ instructions and in accordance with our Customer Terms of Service, which prohibit us from using the information except as necessary to provide and improve the Subscription Service and as required by law.
Our customers control and are responsible for correcting, deleting or updating the information they process using the Subscription Service and for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to transferring the Personal Data to Evolving Intelligence for processing purposes.
What Information Collected and Processed for Subscription Service
Usage Data
Usage data of user’s interactions with the Subscription Service is collected and maintained by EI. Usage data includes metrics and information regarding use and interaction with the Subscription Service such as platform features and services used. Third party providers are used to collect user’s usage data.
2. How is Personal Data Shared
Mobile
When accessing or using Subscription Service via mobile applications, information such as device model and version, operating system, or device identifiers is collected.
Third Party Integrations
Third party integrations with the platform may request certain permissions to access data or send information to your Evolving Intelligence account. It is your responsibility to review any third-party integration requests before authorizing or granting consent.
Any permission(s) granted by you, grants these third-parties access to your data, which may include (but is not limited to) granting third party applications access to view, store, and modify your EI platform subscription account data. EI is not responsible for the practices of third-party integrations. Carefully review the permissions being granted to third party applications.
Information Collected from Other Sources
Evolving Intelligence Partners
EI may collect and share information about registered user’s information collected through our partner co-marketing partnerships, business, solution, and sales partners. For more information about how the data is shared with our partners, review the “Partners” subsection of the “How Personal Data is Shared” provision of this privacy policy.
Third Parties
Information may be received from third party service providers, from related companies, and from our business, solution, and sales partners.
Personal Data from Different Sources
Personal information collected and personal information received from other sources, such as third-party providers of business information and publicly available sources (like social media platforms) may include physical mail addresses, job titles, email addresses, phone numbers, IP addresses, and social media profiles. This helps us update and improve our records, identify new customers, create more personalized advertising, suggest products and services that may interest you, deliver personalized communications and promote events. The collection of your Personal Data by these third-party providers is governed by the provider’s privacy policy.
Log Files
Like most websites and technology services delivered over the Internet, information about hardware and software information may be collected and stored when visiting our websites, using our product and services, or visiting other sites or services that link to this Privacy Policy. This information can include IP addresses, browser type, domain names, internet service provider (ISP), and the files viewed on our websites (e.g., HTML pages, graphics, etc.), the files viewed on our Site, your operating system, access times and referring website addresses.
For Subscription Service, the above categories of information may be collected and stored in log files and database in the following instances, subject to the customer’s implementation settings:
- When a user logs into their account and accesses tools in the Evolving Intelligence Platform;
- When a user visits a customer’s website, if the website is hosted by the Evolving Intelligence Platform or Service; or
- When a user visits a customer’s website, if the customer’s website is self-hosted, if the customer uses Evolving Intelligence’s API, and if the customer uses Evolving Intelligence AI.
Buttons, tools, and content from other companies
Our website may include features and widgets (such as the share and/or “like” button or interactive mini-programs) that run on our websites. These features may collect IP address, which page visited on our Site, and may set a cookie to enable the feature to function properly. These features and widgets are either hosted by a third party or hosted directly on our websites. This Privacy Policy does not apply to these features. Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.
Google reCAPTCHA Enterprise is used on certain products and services to prevent malicious software from engaging in abusive activities on our websites. 3. How is Personal Data Used
To Communicate About the Product and Services
Account information provided to EI when signing up for the Subscription Service is used to send transactional emails or in-app notification about billing, account management, and other administrative matters. Updates regarding our Customer Terms of Service or other legal agreements may also be communicated about security incidents via email or in-app notification.
Information gathered is also used to provide customer support, such as resolving technical issues encountered and analyze product outages or bugs.
If using EI mobile applications, notifications will be pushed periodically to provide updates about events and promotions. Communications can be stopped by turning off notifications at the device level.
To Provide Subscription Service
Account information and Customer Data is gathered to provide product and services information. For example, email address is used to provide when signing up to the Platform or to create a user account, and payment information is used to process payments for paid use of the Subscription Service. This information is also used to authenticate and authorize users when logged in and to provide customer support.
To Improve and Develop Our Product and Services
Usage data is collected about interaction with our Platform, Services, and AI. This data is used to develop and to improve our products, services, and AI. For example, we use usage data to assess trends and usage across the Platform to help us identify and determine new features or integrations users may be interested in.
We use Customer Data for machine learning that support certain products and development of features and functionality with the Subscription Service and similar products and services. Users may opt-out of having your Customer Data used for machine learning by contacting EI.
Anonymized data may be published about our Platform and Services is being used across the Customer base. When sharing statistical information externally, the data is aggregated and anonymized.
To Secure and Protect our Product and EI Users
User account information is used to investigate and help prevent security incidents. This information is also used to meet legal requirements. User information is used to verify user accounts, new product sign-ups, and to detect and prevent product abuse.
Log files are used to provide general statistics regarding use of the websites, Platform, and Services, including location (for analytics, export control and regulatory purposes) and to help improve the navigation experience. IP addresses are also collected and logged for security and debugging purposes, for example to track access patterns, investigate security events and incidents. For these purposes we do cross-reference this automatically collected data to other personal data provided such as name, email address, address, and phone number.
To Market and Promote the Subscription Service
User information is provided to EI to market and promote the Platforms, Services, and other offerings. For example, we use this information, like your email or physical address, to send information which we believe may be of interest by post, email, or other means and send you marketing communications relating to our business.
You may opt out of receiving this promotional content by following the instructions contained in each communication that is sent by contacting [email protected]. If unsubscribed from our marketing lists, we will continue to contacting regarding administrative matters and to respond to other user requests.
If a call is scheduled with an Evolving Intelligence representative, we may record and transcribe the call. Users will be notified prior to the call that the call is being recorded, and opportunity offered to opt-out of having the call recorded.
Where required by law, marketing communications will be sent with your consent. Otherwise, marketing and advertisement information will be sent of our Platforms and Services based on legitimate business interests.
Information received from third party service providers and other sources such as third party providers of business information and publicly available sources may be used in combination with other information collected through other means described in this Privacy Policy for the purposes of providing you with updates and an improved Subscription Service, like personalized communications, event promotion, and tailoring the websites or product to improve user experience.

4. How is Personal Data Shared
Service Providers
Personal Data may be shared with our third-party service providers to support our websites, products, and services. For example, service providers are used for data hosting, application development, marketing, sales support and customer support. Your information may need to be shared with these service providers to provide information about products or services for you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis on your use of the Subscription Service or interactions on our websites, providing marketing assistance, processing credit card payments, supplementing the information you provide us in order to provide you with better service, developing and improving the product and services, and providing customer service or support. These service providers are prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your information. In all cases where your information is shared in this way, third-party service providers are explicitly required to acknowledge and adhere to our privacy and data protection policies and standards.
Partners
Your data may be shared with trusted EI partners to contact registered users based on your request to receive such communications, help us perform statistical analysis, provide sales support, or provide customer support. Partners are prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your data.
EI also partners with trusted third parties to provide co-marketing content of relevance. When engaging with these co-marketing partners, users will be informed who the data is being shared with and provide a link to the co-marketing partner’s privacy policy. These co-marketing partners are required to adhere to our privacy and data protection policies.
Corporate Events
In the event EI is acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by EI on the websites and the Subscription Service and AI. In this event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your Personal Data, and choices you may have regarding your Personal Data.
Public Forums
Our websites may offer publicly accessible message boards, blogs, and community forums. If any information is directly disclosed through our public message boards, blogs, or forums (including profile information associated with the account you use to post the information) it may be read, collected, and used by any member of the public who accesses these websites. Posts and certain profile information may remain even after account termination. Users are urged to consider the sensitivity of any information disclosed in this way.
Compelled Disclosure
EI reserves the right to use or disclose your Personal Data if required by law or if EI reasonably believes that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process. If using Subscription Service, Customer Data is considered Confidential Information and encourage reviewing the Confidentiality terms in the Customer Terms of Service for more information.
5. How is Personal Data Securely Stored
Data Storage and Security
We use a variety of security technologies and procedures to help protect your Personal Data from unauthorized access, use or disclosure. We secure the Personal Data you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. All Personal Data is protected using appropriate physical, technical and organizational measures.
Retention of Personal Data
Retention of your collected data depends on the type of information and how this information is collected and stored. After a reasonable time, data will either be deleted or anonymized or, if this is not possible, then data is securely stored isolated from any further use until deletion is possible.
Personal Data provided is retained on an ongoing legitimate business need to do so (for example, as needed to comply with our legal obligations, resolve disputes and enforce our agreements).
With no ongoing legitimate business need to process your Personal Data, your data may be securely deleted or anonymized if this is not possible, your Personal Data will be secured and isolated from any further processing until deletion is possible. This information is deleted this information at an earlier date if you so request, as described in the section “Privacy Rights and Choices” below.
If elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us or ceased using your EI account. Information derived from cookies is retained and other tracking technologies for a reasonable period from the date such information was created.
The data our customers process in connection with the Subscription Service is retained according to the EI Customer Terms of Service and Customer Data Processing Agreement.

When visiting our websites, signing up for an EI account, attending a EI virtual event, or requesting for information about EI, information is collected automatically using tracking technologies, like cookies and tracking pixels. EI and our partners use cookies or similar technologies (such as web beacons and JavaScript) to analyze trends, administer the website, monitor how visitors navigate around the websites, and to gather demographic information about our user base. 7. Privacy Rights and Choices
Personal Data Requests
You have the following data protection rights:
- Access, Correction or Deletion. You can request access, correction, updates or deletion of your Personal Data.
- Objection. You can object to our processing of your Personal Data, ask us to restrict processing of your Personal Data or request portability of your Personal Data.
- Withdraw Consent. If we have collected and processed your Personal Data with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.
- Complaint. You have the right to complain to a data protection authority about our collection and use of your Personal Data.
We do not sell personal information.
Please note to protect personal information, your identity may be verified by a method appropriate to the type of request. Depending on your location, you may be entitled to empower an “authorized agent” to submit requests on your behalf. Authorized agents are required to confirm their identity and authority, in accordance with applicable laws.
Your request to change, correct, or delete your data will be managed within a reasonable timeframe and a notification will be sent with confirmation. In some instances, your rights may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights.
If you are a customer, prospect, or otherwise interact with an EI customer that uses our Subscription Service and would like to access, correct, amend or delete your data controlled by the customer, please contact the relevant customer directly. EI acts as a processor for our customers and will work with our customers to fulfill these requests when applicable.
Anti-Spam Policy
Our Acceptable Use Policy applies to us and to our customers and, among other things, prohibits use of the Subscription Service to send unsolicited commercial email in violation of applicable laws, and requires the inclusion in every email sent using the Subscription Service of an “opt-out” mechanism and other required information. We require all of our customers to agree to adhere to the Acceptable Use Policy at all times, and any violations of the Acceptable Use Policy by a customer can result in immediate suspension or termination of the Subscription Service.
To Unsubscribe from Our Communications
You may unsubscribe from our marketing communications through one of the following methods:
- by clicking on the “unsubscribe” link located on the bottom of our e-mails;
Customers cannot opt out of receiving transactional emails related to their account with us or the Subscription Service.
To Unsubscribe from Our Customers’ Communications
Our customers are solely responsible for their own marketing emails and other communications; we cannot unsubscribe you from their communications. Individuals who interact with an EI customer can unsubscribe from our customers’ marketing communications by clicking on the “unsubscribe” link located on the bottom of their emails, or by contacting them directly.

Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

Forms

How long we retain your data
Registered user information is retained in your website’s database for 30 days.
Data can be exported or removed upon users request via the existing WordPress data exporter or eraser.
If syncing data to a 3rd party service (e.g Mailchimp via our MailChimp extension), data is retained there until unsubscribed or deleted.
Where we send your data
Ultimate Member does not send any user data outside of your site by default.
If you have extended the functionality of the plugin (e.g sending registered user data to MailChimp via our MailChimp extension, this user info may be passed to these external services. These services may be located abroad and outwith the EU.
